Terms of Service for Proxy War

Please read these Terms of Service ("Terms") carefully before using the Proxy War website and game (collectively, the "Service"), operated by Crimson Meridian Studios ("Proxy War," "we," "us," or "our").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.
1. Eligibility
The Service is not directed to children under the age of 13, and you must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you may only use the Service with the involvement and consent of a parent or legal guardian.
By using the Service, you represent that you meet these eligibility requirements.
2. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last Updated" date above. Changes take effect as soon as they are posted. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
3. The Service
Proxy War is a website and game provided for entertainment purposes. We reserve the right to modify, suspend, or discontinue the Service (or any part of it), temporarily or permanently, at any time and without notice or liability to you.
We do not guarantee that the Service will be available at all times, uninterrupted, secure, or error-free.
4. Accounts
Access to the online features of the Service is managed through Steam, a third-party platform operated by Valve Corporation ("Valve"). To access the online components of the Service, you must have a valid Steam account in good standing and comply with the Steam Subscriber Agreement and any other applicable Valve terms and policies.
You are responsible for: - Maintaining the security and confidentiality of your Steam account credentials - All activity that occurs in connection with the Service through your Steam account - Ensuring your use of Steam complies with Valve's own terms of service
We do not control, and are not responsible for, Steam's availability, account authentication, billing, or any other aspect of the Steam platform. If your Steam account is suspended, terminated, or otherwise unavailable, you may lose access to the online features of the Service, and we will have no liability to you as a result.
You must notify us promptly if you become aware of any unauthorized use of your Steam account in connection with the Service.
5. Acceptable Use
When using the Service, you agree that you will not: - Violate any applicable local, state, national, or international law or regulation - Use cheats, exploits, automation software (bots), hacks, mods, or unauthorized third-party software designed to modify or interfere with the Service - Attempt to gain unauthorized access to the Service, other users' accounts, or any systems or networks connected to the Service - Interfere with or disrupt the integrity or performance of the Service, including introducing viruses, malware, or other harmful code - Harass, threaten, or abuse other users - Impersonate any person or entity, or misrepresent your affiliation with any person or entity - Scrape, data-mine, or use automated means to access the Service without our prior written consent - Reverse engineer, decompile, or disassemble any portion of the Service, except where permitted by applicable law - Use the Service for any commercial purpose without our prior written consent
We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates this section, including suspending or terminating access to the Service.
6. Intellectual Property
The Service, including all content, features, game assets, graphics, text, software, and functionality (collectively, "Content"), is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws.
Except as expressly permitted under these Terms, you may not copy, modify, distribute, sell, lease, or create derivative works based on the Service or its Content without our prior written consent.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial entertainment, subject to your compliance with these Terms.
7. User Content
If the Service allows you to submit, post, or share content (such as usernames, messages, or in-game creations) ("User Content"), you retain any ownership rights you may have in your User Content. However, by submitting User Content, you grant us a worldwide, royalty-free, non-exclusive license to use, reproduce, display, and distribute that User Content in connection with operating and promoting the Service.
You are solely responsible for your User Content and represent that you have all necessary rights to submit it and that it does not violate these Terms or any applicable law.
8. Third-Party Services
The Service uses Google Analytics to collect analytics information, as described in our Privacy Policy. The online features of the Service also rely on Steam, a third-party platform operated by Valve, to manage account access. Your use of Steam in connection with the Service is subject to the Steam Subscriber Agreement and Valve's other applicable terms and policies, available at https://store.steampowered.com/subscriber_agreement/. We are not a party to your agreement with Valve and are not responsible for Steam's operation, availability, or practices.
The Service may also link to or integrate with other third-party websites or services that are not owned or controlled by us. We are not responsible for the content, privacy practices, or terms of any third-party services.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
WE DO NOT WARRANT THAT ANY DEFECTS OR ERRORS WILL BE CORRECTED, OR THAT THE SERVICE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PROXY WAR, ITS OPERATORS, AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED [Insert Amount, e.g., $100 USD or the amount you paid us, if any, in the preceding 12 months].

You may stop using the Service at any time. Sections of these Terms that by their nature should survive termination (including but not limited to Sections 6, 9, 10, 11, and 14) will survive.
13. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict of law principles.
Any dispute arising out of or relating to these Terms or the Service shall be resolved in the state or federal courts located in New Jersey, and you consent to the personal jurisdiction of such courts.
